CLYR Controller and CLYR+ Controller Three-Year Limited Warranty

This limited warranty is provided by Aquatech Partners d/b/a Clyrpool (CLYR), 10795 Hammerly Blvd., Space A08, Houston, Texas 77043. It applies to the CLYR Controller and CLYR+ Controller purchased from CLYR or an authorized CLYR seller.

Coverage applies to the controller hardware identified by the original product SKU and serial number. Accessories, third-party equipment, installation work, pool equipment, sensors, probes, cabling, power supplies, and other items are not covered by this controller warranty unless they are expressly included in a separate written CLYR warranty.

The warranty period is three years beginning on the original date of purchase shown on a valid receipt, invoice, or CLYR order record. If proof of purchase is unavailable, CLYR may use its documented shipment, activation, or installation date to determine the start of coverage.

A replacement controller does not begin a new three-year period. It remains covered for the unexpired portion of the original controller's warranty period.

CLYR warrants that the covered controller will be free from defects in materials and workmanship under normal use and when installed, powered, wired, configured, and maintained in accordance with the applicable CLYR owner documentation and electrical and safety requirements.

A covered defect is a hardware failure that prevents the controller from performing its intended controller functions and that is not excluded below. Software, cloud, connectivity, or application issues that can be corrected without replacing the controller hardware are not controller hardware defects.

For an eligible claim, CLYR's warranty remedy is replacement of the failed controller with a controller bearing the exact same SKU. This warranty does not provide an upgrade, model conversion, or substitution for a different controller SKU.

CLYR will approve and ship the exact-SKU replacement no later than 30 calendar days after CLYR receives a complete claim form containing the information and evidence reasonably required by this warranty. If CLYR requests a missing item within five business days after submission, the claim becomes complete when that requested item is received. The 30-day period then runs from that completion date.

CLYR will pay the cost of the replacement controller and standard outbound shipping. CLYR will also provide prepaid standard return shipping if it requests return of the failed controller. Expedited shipping, removal, installation, reinstallation, electrician, pool-service, water-treatment, travel, and other labor or incidental costs are not included unless required by applicable law or separately agreed in writing.

Submit the controller warranty claim form at www.clyrpool.com/warranty/controllers. The claimant must provide accurate contact, purchase, product, defect, and condition information and must reasonably cooperate with remote diagnostics and safe troubleshooting requested by CLYR.

Do not open the enclosure, alter wiring, bypass safety devices, or attempt a repair solely to diagnose a warranty claim. If CLYR requests the failed controller, preserve it in substantially the condition existing when the claim was submitted and return it using CLYR's prepaid instructions.

• Claimant name; customer or company name; email; phone; and complete shipping address.
• Controller model, exact SKU, serial number, original purchase date, seller or order number, and proof of purchase.
• Date the defect was first noticed and a clear description of the symptoms and troubleshooting already performed.
• Clear photographs of the controller, enclosure, serial label, and installed wiring, plus disclosure of any impact, water intrusion, opening, modification, repair, or tampering.
• Authorization for CLYR to review controller diagnostic and telemetry records reasonably related to the claim.

Streamlined replacement eligibility requires the controller to be free from physical damage, unauthorized opening, unauthorized modification, altered or removed identifying labels, and other known tampering. CLYR may inspect photographs, diagnostic data, security indicators, wiring, and the returned controller when determining eligibility.

CLYR may deny coverage when physical damage, unauthorized modification, improper repair, or tampering caused or materially contributed to the claimed failure. CLYR will not deny coverage solely because a consumer used non-CLYR parts or independent service unless CLYR reasonably determines that the part or service caused or materially contributed to the failure, or unless otherwise permitted by law.

This limited warranty does not cover failures, damage, or service needs caused by or resulting from any of the following:

• Impact, crushing, cracked or punctured enclosures, fire, flooding, standing water, chemical exposure, corrosion, pest intrusion, vandalism, theft, or other physical damage.
• Improper installation, mounting, grounding, bonding, wiring, voltage, current, overcurrent protection, or use contrary to CLYR documentation, electrical codes, or stated environmental ratings.
• Power surge, lightning, utility disturbance, generator or inverter output outside specification, or connection to unsupported equipment.
• Misuse, abuse, neglect, accident, unauthorized opening, modification, altered firmware, bypassed safety features, improper repair, or tampering that caused or materially contributed to the failure.
• Cosmetic wear that does not affect intended function, including scratches, fading, discoloration, labels, or ordinary weathering.
• Third-party equipment, pumps, heaters, valves, relays, salt systems, wiring, network services, internet service, mobile devices, or software and cloud interruptions that do not arise from a covered controller hardware defect.
• Routine maintenance, configuration, calibration, installation correction, or issues resolved through a software, firmware, network, or account change without replacement hardware.
• A product whose serial number, SKU, ownership record, or proof of purchase cannot reasonably be verified.

The replacement may be new or professionally recertified, but it will be the exact covered controller SKU and will be functionally equivalent to a new unit of that SKU. CLYR may require the failed controller to be returned after the replacement ships. Returned hardware becomes CLYR property when replacement is completed.

Replacement does not include migration, configuration, field labor, removal, installation, electrician work, pool downtime, water treatment, or replacement of non-CLYR equipment. The purchaser is responsible for arranging qualified installation and for following all safety instructions.

To the maximum extent permitted by applicable law, the exact-SKU replacement described in this warranty is the exclusive remedy for breach of this written limited warranty. CLYR is not responsible under this warranty for loss of use, loss of water, chemical imbalance, damage to other equipment, service calls, labor, lost revenue, or indirect, incidental, special, exemplary, punitive, or consequential damages.

These limitations do not apply where prohibited by law and do not limit liability that cannot lawfully be limited, including any applicable rights relating to personal injury caused by a defective product.

To the extent permitted by law, any implied warranty applicable to the covered controller, including merchantability or fitness for a particular purpose, is limited in duration to the three-year term of this written warranty. Some states do not allow limitations on how long an implied warranty lasts or exclusions of incidental or consequential damages, so those limitations or exclusions may not apply to you.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. Nothing in this warranty excludes or restricts a right or remedy that cannot be excluded or restricted under applicable law.

This document is the complete written limited warranty for the covered controller hardware. No reseller, installer, employee, contractor, or other person may change it or make an additional warranty on CLYR's behalf unless the change is in a written instrument signed by an authorized CLYR representative.
